REPORT FROM THE COMMISSION TO THE EUROPEAN PARLIAMENT AND THE COUNCIL Second Report on the Application of Council Regulation (EC) No 723/2009 of 25 June 2009 on the Community legal framework for a European Research Infrastructure Consortium (ERIC)

1. This section provides an overview of European Research Infrastructure Consortia (ERICs) and summaries contents of the second annual report on Community legal framework for ERICs.


2. ERICs are legal entities set up to deliver international science collaborations, where the resources - be it funding, knowledge or expertise – are likely to be difficult for one country or organisation to deliver alone. Whilst funded primarily by the individual ERIC members, they are set up under Council Regulation (EC) No 723/2009 of 25 June 2009 – the “ERIC Regulation”. However, each has flexibility to define its own rules and procedures (statutes) agreed with the ERIC Member states.

3. The European Commission first reported on the application of the ERIC Regulation on 14 July 2014 and invited the European Commission to present the next report by 2017.

4. The Second Report on the ERIC Regulation was published on the 11 July 2018 and summarises the conclusions of the first report; highlights the evolution of the ERIC landscape since the previous report; looks at the challenges surrounding the implementation of the ERIC Regulation; reviews the role of the European Commission services and focuses on recurrent issues and the next steps.

ERIC Regulation

5. The ERIC Regulation was adopted in 2009 to facilitate the quick establishment and operation of large European Research Infrastructures (RIs), either single sited or distributed in nature. It addresses one of the major difficulties identified in the establishment of these RIs – the lack of an appropriate legal framework to allow for pan-European collaboration other than setting up a bespoke treaty for each. The ERIC Regulation was amended in December 2013 to better reflect the contributions of countries associated to the EU Research and Innovation (R&I) Framework Programmes (hereinafter referred to as ‘associated countries’), including the possible hosting of ERICs in such countries.
