Proposal for a REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL laying down conservation and control measures applicable in the Regulatory Area of the Northwest Atlantic Fisheries Organisation and repealing Council Regulation (EC) No 2115/2005 and Council Regulation (EC) No 1386/2007

1. This proposal aims to ensure that all management measures including control and enforcement measures agreed at NAFO (North West Atlantic Fisheries Organisation) are transposed into EU law. The Commission is taking this opportunity to not only transpose new measures but also to consolidate existing measures into one new piece of legislation and update the language of some articles to more closely reflect those found in the NAFO scheme of control and enforcement (control and enforcement measures or CEM).

2. The existing CEM in this proposal have already been agreed at NAFO and supported by the EU in accordance with its negotiating mandate obtained prior to the NAFO annual meetings.

3. The proposal also includes provision for certain delegated powers, i.e. for the Commission to be able to make tertiary legislation to ensure EU legislation remains aligned with changes agreed by NAFO in the future. The Commission has reviewed the nature of changes to measures adopted by NAFO since 2008 and is proposing delegated powers to cover these types of change and those which are expected to be made in coming years. The list of areas for which delegated powers would be granted includes, for example these powers to alter deadlines for submission of data/documents, the list of violations constituting serious infringements, certain limitations on efforts and catch levels, and technical measures.

4. The Commission has also included a provision which would allow it to publish certain types of changes to the NAFO CEM in the EU Official Journal and thereby make them binding without formal legislation. This would enable the EU to quickly enact changes to existing measures in order to avoid any gaps in implementation.
