Proposal for a REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL implementing the Kimberley Process certification scheme for the international trade in rough diamonds (recast)

1. The proposed Regulation re-casts Council Regulation (EC) No. 2378/2002 (“the current EU Regulation”). The Regulation governs the implementation of the Kimberley Process Certification Scheme (KPCS) for the international trade in rough diamonds across the European Union.

2. The KPCS regulates the global trade in rough diamonds with the aim of preventing the flow of conflict diamonds. Conflict diamonds are rough diamonds used by rebel movements or their allies to finance conflict aimed at undermining legitimate governments. The current EU Regulation provides for the EU’s import and export of rough diamonds to be in accordance with the requirements of the KPCS. The current EU Regulation was included in Annex 2 of the Northern Ireland Protocol and therefore applies to and in the United Kingdom in respect of Northern Ireland.

3. Since 2002, the current EU Regulation has been amended numerous times. The proposed EU Regulation consolidates these amendments, removes some out-of-date text, and makes other minor amendments (for example, updating references from “Community authority” to “Union authority”). It also makes changes to the functions of the EU Committee, made up of representatives of Member States, which assists the European Commission in the performance of the duties and functions conferred on the Commission.

4. The EU’s Explanatory Memorandum characterises the amendments to be made in relation to the EU Committee, which can be found in Article 20 of the proposed EU Regulation, as substantive. We do not however anticipate that these amendments will have a material effect on the operation of the EU Regulation in Northern Ireland. The amendments relate to the scope of the functions of the EU Committee rather than to the operation of the EU Regulation in Member States, or to the obligations of Member States.
