Proposal for a REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL amending Regulation (EU) 2017/2403 as regards fishing authorisations for Union vessels in United Kingdom waters and fishing operations of United Kingdom fishing vessels in Union waters
1. In preparation for the UK’s exit from the EU, on 4 September 2019 the European Commission (EC) published a proposal to extend regulation (EU) 2019/498 to enable continued reciprocal fishing access to continue until 31 December 2020.
2. This proposal was announced by the EU as part of its contingency planning in the event that the UK leaves the EU without a Withdrawal Agreement in place. On 12 June 2019 the EC published a Communication on the state of play of these contingency measures and concluded that they were still fit for purpose. However, it also noted that given the extension of Article 50(3) TFEU until 31 October 2019, certain measures such as Regulation (EU) 2019/498 would remain necessary during 2020.
3. This proposal would therefore extend the amendments made by Regulation (EU) 2019/498 to Regulation (EU) 2017/2403, so that they continue beyond 2019 and end on 31 December 2020. It would extend the time during which a simplified legal framework would apply for authorisations for UK vessels to fish in EU waters and EU vessels to fish in UK waters. The subject matter was fully covered in the Explanatory Memorandum for 2019/498 and the issues outlined at that time have not changed.
