Proposal for a COUNCIL REGULATION on fixing the export refunds on poultrymeat
1. On 18 July 2013, the European Commission adopted Implementing Regulation (EU) No 689/2013, setting the export refunds for poultry meat to zero.
2. The process by which the Commission consulted with Member States and adopted the regulation was challenged in the Court of Justice for the European Union (CJEU). On 20 September 2017, the CJEU ruled that Regulation 689/2013 was invalid as its adoption did not comply with procedural rules. However, for the sake of legal certainty, the Court determined that the effects of the regulation be maintained until the entry into force of a new act intended to replace Regulation 689/2013.
3. The purpose of this proposal is to replace Regulation 689/2013 for the period between its original entry into force on 19 July to 31 December 2013. Regulation (EU) No 1308/2013 of the European Parliament and the Council has set export refunds at zero with effect from 1 January 2014.
