COMMISSION DELEGATED REGULATION (EU) …/... of 12.7.2021 amending Annex II to Regulation (EU) 2018/848 of the European Parliament and of the Council as regards the requirements for recordkeeping for operators in organic production
1. This delegated regulation amends organic production rules in Annex II of Regulation (EU) 2018/848 from 1 January 2022, requiring operators to keep specified additional records where such records are not already required under other relevant legislation; it will have effect in Northern Ireland.
2. The new Organics Regulation (EU) 2018/848 on organic production and labelling was announced on 14 June 2018: it repeals EU Regulation 834/2007 (while still permitting the import of third country organic goods under that Regulation until no later than 31 December 2024), and largely replaces its implementing legislation – Commission Regulation (EC) No 889/2008 and Commission Regulation (EC) No 1235/2008. (Regulations 843/2007, 889/2008 and 1235/2008 are retained in UK legislation.) The organic regulations are implemented in Northern Ireland by the Organic Products Regulations (Northern Ireland) 2020 (S.R. 2020 No. 272): these currently refer to Regulations 834/2007, 889/2008 and 1235/2008, so will require amendment when Regulation 2018/848 enters into force.
3. The implementation of Regulation (EU) 2018/848 was delayed by the EU Commission from 1 January 2021 to 1 January 2022.
4. The regulation will apply in all EU member states and NI, under the terms of the Northern Ireland Protocol. The Trade and Cooperation Agreement (TCA) also sets out an equivalency agreement on organic products between the EU and UK until 31 December 2023.
